OVERVIEW
Welcome to Teeps The Jeweller. The terms “we”, “us” and “our” refer to Teeps The Jeweller. Teeps The Jeweller operates this website and store, including all related information, content, features, tools, products and services (the “Services”). Teeps The Jeweller is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”) govern your use of the Services. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, you must not use our Services.
SECTION 1 – ELIGIBILITY AND ACCOUNTS
By using our Services, you confirm that you are at least 18 years of age or the age of majority in your jurisdiction.
You agree to provide accurate and complete information when placing orders or creating an account. You are responsible for maintaining the confidentiality of your account details and for all activity under your account.
Accounts may not be transferred or sold.
SECTION 2 – PRODUCT INFORMATION
We take care to accurately represent our jewellery and gemstones. However:
• Colours and appearance may vary between screens
• CAD and rendered images are illustrative only
• Natural diamonds and gemstones vary by nature
• Carat weights and measurements are approximate
• Hand-finished items may show minor variations
These variations do not constitute faults.
We reserve the right to modify or discontinue products at any time and to limit quantities.
SECTION 3 – CUSTOM AND MADE-TO-ORDER ITEMS
Many of our pieces are made to order or customised.
Once production has commenced, orders generally cannot be cancelled or changed.
Custom, personalised and made-to-order items are not eligible for change of mind returns.
This does not affect your rights under the Australian Consumer Law.
SECTION 4 – ORDERS AND ACCEPTANCE
Placing an order constitutes an offer to purchase. Orders are not accepted until confirmed by us.
We reserve the right to:
• refuse any order
• cancel orders affected by pricing errors
• request additional verification
Payment must be received and cleared before production or dispatch.
SECTION 5 – PRICING AND PAYMENT
All prices are in Australian Dollars (AUD).
Unless stated otherwise:
• Prices include GST
We reserve the right to change prices at any time prior to order acceptance.
You warrant that you are authorised to use the payment method provided.
SECTION 6 – SHIPPING AND RISK
Delivery timeframes are estimates only.
We are not responsible for delays caused by carriers, customs, weather or events outside our control.
Risk and title pass to you once the product is handed to the shipping carrier.
You are responsible for providing a secure delivery address.
SECTION 7 – RING SIZING
Customers are responsible for ensuring the correct ring size prior to ordering.
If resizing is required after delivery:
One complimentary resize within one month of receiving your Classic ring (up to 2 sizes larger). Resizing more than 2 sizes larger will incur a fee and be quoted on at the time.
Resizing needs do not constitute a fault.
SECTION 8 – WEAR, CARE AND STONE SECURITY
Fine jewellery is subject to normal wear and tear.
Over time, settings may loosen due to:
• daily wear
• impact
• accidental damage
• normal metal wear
We strongly recommend regular professional inspections.
To the extent permitted by law, Teeps The Jeweller is not responsible for loss of stones or damage resulting from wear, impact, misuse or failure to maintain the piece.
This does not exclude your rights under the Australian Consumer Law.
SECTION 9 – INTELLECTUAL PROPERTY
All content on the Services, including:
• TEEPS name and hallmark
• logos
• product designs
• CAD renders
• photographs
• text and graphics
is owned by Teeps The Jeweller or its licensors and protected by intellectual property laws.
You may not copy, reproduce or use our content without prior written permission.
SECTION 10 – OPTIONAL TOOLS
Third-party tools may be provided “as is” and “as available” without warranties. Your use of such tools is at your own risk.
SECTION 11 – THIRD-PARTY LINKS
We are not responsible for third-party websites linked from our Services. Accessing them is at your own risk.
SECTION 12 – RELATIONSHIP WITH SHOPIFY
Teeps The Jeweller is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Teeps The Jeweller.
By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sales between you and Teeps The Jeweller.
SECTION 13 – PRIVACY
Your submission of personal information is governed by our Privacy Policye.
Because the Services are hosted by Shopify, certain information is also processed by Shopify in accordance with its Privacy Policy.
SECTION 14 – FEEDBACK AND REVIEWS
If you submit reviews, feedback or other content, you grant us a perpetual, royalty-free licence to use that content for marketing and business purposes.
You confirm you have the rights to submit such content.
SECTION 15 – ERRORS AND OMISSIONS
We reserve the right to correct any errors, inaccuracies or omissions and to cancel affected orders at any time.
SECTION 16 – DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services and products are provided “as is”.
Nothing in these Terms excludes, restricts or modifies any consumer guarantees under the Australian Consumer Law.
Where permitted, our liability is limited to repair, replacement or refund.
SECTION 17 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Teeps The Jeweller is not liable for any indirect or consequential loss arising from use of the Services or products.
This limitation is subject to your rights under the Australian Consumer Law.
SECTION 18 – INDEMNIFICATION
You agree to indemnify and hold harmless Teeps The Jeweller and Shopify from claims arising from your breach of these Terms or misuse of the Services.
SECTION 19 – TERMINATION
We may suspend or terminate access to the Services at any time.
Provisions which by their nature should survive termination will remain in effect.
SECTION 20 – GOVERNING LAW
These Terms are governed by the laws of South Australia, Australia. You submit to the exclusive jurisdiction of the courts of South Australia.
SECTION 21 – CHANGES TO TERMS
We may update these Terms at any time by posting changes on our website. Continued use of the Services constitutes acceptance of those changes.
